Terms of Service

Last updated: July 2026

1. Acceptance of Terms

By accessing or using Trustfy ("the Service"), you agree to be bound by these Terms of Service. Trustfy is a non-custodial peer-to-peer marketplace that facilitates USDT trading through smart-contract escrow on the BNB Smart Chain. If you do not agree to these terms, you may not access or use the Service.

2. Non-Custodial Nature

Trustfy is non-custodial. We never hold, control, or have access to your cryptocurrency. Your USDT is locked in smart contracts on the BNB Smart Chain — only you can authorize transactions with your private keys. We cannot freeze your account, seize your funds, or reverse transactions. You are solely responsible for the security of your wallet and private keys.

3. Smart Contract Escrow

All trades on Trustfy are protected by smart-contract escrow. When a trade begins, the seller's USDT is locked in a smart contract on BNB Smart Chain. Neither the seller, Trustfy, nor any third party can move the funds until the trade is resolved. The smart contract code is the final arbiter of every transaction. Trades are governed by the contract code at the address displayed in the application.

4. Fees

Makers pay 0.5% per offer. Takers pay 1%. Fees are charged only on a trade that completes normally — a dispute or a buyer default never triggers a fee. There are no withdrawal fees, no deposit fees, and no subscription tiers. Gas fees for on-chain transactions on BNB Smart Chain are paid by whoever signs each transaction.

5. Dispute Resolution

If a trade cannot be completed amicably, either party may open a dispute. Independent arbitrators — administratively appointed and authorized on-chain by platform governance, and barred from creating or matching any offer to remain impartial — review evidence including payment proof, chat logs, and on-chain data. Arbitrators rule within hours. The losing party forfeits their dispute bond; the winning party receives the escrowed funds. Arbitrator rulings are final and recorded on-chain.

6. Prohibited Activities

You may not use Trustfy for money laundering, terrorist financing, sanctions evasion, or any illegal activity. You may not attempt to manipulate ratings, create fake accounts, or engage in fraudulent trading. Violations may result in permanent bans and forfeiture of bonds. You must comply with all applicable laws in your jurisdiction, including KYC/AML requirements where applicable.

7. Limitation of Liability

Trustfy is provided "as is" without warranties of any kind. We are not liable for losses resulting from smart contract bugs, network congestion, wallet failures, or counterparty fraud. Our total liability is limited to the fees you paid to us in the preceding 12 months. We are not responsible for fiat payments sent outside our platform.

8. Governing Law

These terms are governed by the laws applicable to Trustfy's operating jurisdiction. Disputes shall be resolved through binding arbitration where possible. By using the Service, you consent to this jurisdiction and dispute resolution process.
